The Tundra Touring Company Canada Ltd. (The Tundra Touring Co.) is pleased to provide you with the opportunity to join him at the 2008 CCMA’s.  

1. ELIGIBILITY. To be eligible for this promotion, an individual must:   a. be a legal resident of Canada (excluding Quebec);   b. be of the age of majority in his/her province of residence or older at time of entry or have a parent/legal guardian sign all necessary documentation on his/her behalf in respect of this promotion, if any;   c. Have been the first to respond, WITH THEIR CONTACT PHONE # IN THEIR MESSAGE to the Twitter message “Be the first to Twitter now to win a trip to the CCMA’s!”   Participants are not eligible if they are employees of The Tundra Touring Company. The Tundra Touring Co. shall have the right at any time to require proof of identity, including photo ID, and/or eligibility to participate in the promotion. Tundra reserves the right to refuse any participant in its sole discretion, should any participant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information relating to eligibility.  

2.    PROMOTION PERIOD. The promotion will take place during a one time Twitter text message in the month of August, 2008.  

3.    HOW TO JOIN PAUL AT THE 2008 CCMA’S. To obtain a maximum of two (2) Westjet return flight to Winnipeg MB, 2 tickets to the 2008 CCMA’s, one hotel room for accommodation, and to visit with Paul Brandt backstage, Participant must do the following:   a.    Simply be the first to respond to the Twitter message sent from paulbrandt that reads “Be the first to Twitter now to win a trip to the CCMA’s!”   b.    Flights, Hotel accommodation, CCMA Tickets, and meet and greet access to Paul Brandt (The Prize) must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash. Any expenses not stated are the sole responsibility of the winner. (The Prize) shall be awarded to confirmed participants only, subject to these rules at all times. All decisions of the The Tundra Touring Co. are final and binding in all regards to this promotion. This promotion is not open to anyone who is prohibited and/or restricted by law from participating.  

4.    LIMITATION OF LIABILITY. The Tundra Touring Co. assumes no responsibility or liability for lost, late, misdirected or incomplete tickets, notifications, or responses. Participant assumes liability for injuries caused or claimed to be caused by participating in the promotion, or by the acceptance, possession, use of, or failure to receive The Prize. Tundra nor any service providers are responsible for any technical, computer, human or other error, including but not limited to, technical malfunctions, lost/ delayed data or voice transmission, omissions, interruption, deletion, defect, line failure of any telephone network, computer equipment, software, inability to access online service or website or to complete a telephone call or facsimile transaction, or any other error or malfunction, or late, lost, or misdirected mail, or any injury or damage to a participant's or any other persons computer related to or resulting from participating in this promotion. Failure to enforce any term of the official rule shall not constitute a waiver of that provision. If for any reason the promotion is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrance, technical failure or other causes which in the opinion of the Tundra or concert promoter, including but not limited to concert cancellation for any reason, Tundra reserves the right, entirely at its discretion, to modify, suspend or terminate this promotion at any time.

5.    CONDUCT. By entering this promotion, participant agrees to be bound by these rules. Tundra reserves the right to decline award of the prize to any person who is found to be: (a) violating these rules; (b) tampering or attempting to tamper with the participation process or the operation of the promotion; or (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any person. ANY ATTEMPT TO DELIBERATELY DAMAGE THE PROMOTION WEBSITE OR ANY RELATED WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, TUNDRAS RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION. PUBCLICITY/USE OF PERSONAL INFORMATION. Participant grants Tundra the right to: (a) use his or her personal information for the purpose of administering the Program; and (b) use his or her name, photograph, likeness, voice, prize information and/or biographical information, including but not limited to the City and Province of residence, for publicity and promotional purposes without further compensation unless prohibited by law; it being acknowledged that the decision to publicize the promotion, winner or any of the entrants, or refrain from doing so, shall be made in Tundra’s sole discretion. Personal information will not be provided to any third party other than as provided for in these Rules.

INTELLECTUAL PROPERTY. All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, logos, slogans and representations are owned by Paul Brandt and The Tundra Touring Co. All rights are reserved. Unauthorized copying or use of any copyrighted or trade-marked material or other intellectual property without the express written consent of its owner is strictly prohibited.

TERMINATION. Tundra reserves the right, in its sole discretion, to cancel, amend, modify or terminate all or any portion of this promotion at any time for any reason without prior notice.

LAW. Entrants agree that any and all disputes, claims and causes of action arising out of, connected with, the promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the Province of Alberta. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred; including costs associated with entering the promotion, but in no event shall include solicitor and client costs or attorneys fees. Under no circumstances will a participant be permitted to obtain awards for, and each participant hereby expressly waives all rights to, claim punitive, incidental and consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of the official promotional rules, the entrants rights and obligations, or the rights and obligations of the Tundra in connection with the promotion, shall be governed by and construed in accordance with the laws of the Province of Alberta, without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any other jurisdiction other than the Province of Alberta
